him. This answer appears to be satisfactory as far as it goes,
that is to say unless and until the defence can show that other, less
innocent, reasons existed for his identification.
As much has been said about the possibility of the photograph
O. P. 163. which was found at Delhi being shown to the witnesses I must
sketch, as briefly as possible, the history of this photograph from
the date of its discovery to the date of the identification proceed-
ings. I note first of all, however, that little or nothing has been
said about the photograph of Banarsi and Ashfaqullah (Ex. P 28)
which was found with Banarsi a year before, though it is obvious 10
that if the police had wished to assist the identifying witnesses
they could have done so quite as easily by showing them this photo-
graph as by showing them the other one, if not more easily. The
reason why the defence have concentrated on the later photograph
appears to be that Ashfaqullah himself, possibly not knowing that
the other one had been found a year before, displayed anxiety
about it soon after his arrest and complained in his statement to
the court about the way in which it had been kept.
In view of the indications given by Ashfaqullah that he
intended to make the most of this photograph a large number of 20
witnesses were brought from Delhi to show exactly what happened
to it. The photograph (Ex. P. A. 37) was found in Ashfaqullah's
box. The box had been sealed up on the 8th September when
Ashfaqullah was arrested and was taken the next day by the
Deputy Superintendent, Khan Bahadur Hakim Ikram-ul-Haq, who
had arrested Ashfaqullah, to the magistrate, Saiyid Ghulam
Mustafa Shah (P. W. 118) to prepare a list of its contents. Ashfaq-
ullah says that he asked the magistrate to destroy it but the
evidence of the Deputy Superintendent and the magistrate shows
that he did not make any such request until the 13th. The 30
police did not at first pay much attention to the photograph as
it was not a very good likeness; indeed they appear to have
been doubtful whether it was Ashfaqullah's photograph. His
O. P. 164. letter to his sister found in his possession (Ex. P. A. 6) shows
that he intended to send the photograph to her at the first
opportunity, "although it is very dim. If I get an opportunity
I will send you a good photo". When on the 13th, Ashfaqullah
for the first time displayed anxiety about the photograph the
Deputy Superintendent told him that it had been put back into
the box, the key of which had been kept by him. He also assu- 40
red him that no undue advantage would be taken of it. The box was
kept in the police malkhana. It is clear from this evidence that
the photograph was not sent to Lucknow and shown to the
witnesses between the 9th and 13th September. On the 13th
September, Mr. Horton arrived at Delhi and wanted to see some of
the things found with Ashfaqullah. Khan Bahadur Tasadduq Husain,
Deputy Superintendent attached to the office of the Director of
( 105 )
Criminal Intelligence came to the malkhana on this date, exa-
mined the list of articles in the box and took away certain of
them. Ex. P. A. 40 shows what things were taken by him and
what were not. The photograph was not taken. On this date
the photograph was placed in a sealed cover by Sub-Inspector
Sirajul Haq (P. W. 120). On the 14th the Deputy Superintendent,
Khán Bahadur Ikramul Haq, sent for the cover to see that it had
been properly sealed and finding that it was, returned it to the
malkhana by sub-inspector Sirajul Haq. He brought the cover to
10 Lucknow on the 30th October in the same condition as it was in on
the 14th September. Ex. P. A, 42-49 are various police reports re-
lating to this box and photograph. They support the evidence of
the witnesses named above, as does also the evidence of various
head constables which it is unnecessary to narrate in detail. It is
sufficient to say that the evidence proves conclusively that the
photograph was locked up in the box from the 8th to the 13th
September and that from the 13th September to the 30th Octo- O. P. 165.
ber it remained at Delhi in a sealed cover. The identification
proceedings of Ashfaqullah took place at Lucknow on the 28th
20 September.
114. As regards the other allegations made by or on behalf
(b) Identification proceed- of Ashfaqullah the evidence of the committing
magistrate, Khan Saheb Saiyid Ainuddin (P.
W. 17) is important. This shows that the ma-
gistrate arrived at Delhi on the 27th September for the purpose of
conveying him to Lucknow. Before leaving the jail he told
Ashfaqullah to keep his features concealed as there would be identi-
fication proceedings. Ashfaqullah was taken to the station in a
closed lorry and he and the magistrate travelled to Lucknow in a
30 reserved second class carriage, the blinds of which were drawn.
From Lucknow station to the Central Jail he was taken part of the
way in a closed hackney carriage and the remainder of the way in
a lorry. At all railway stations his face was covered and he wore
a pair of black glasses. Ex. P. A. 51 is the note recorded about
this journey by the magistrate.
At Lucknow Saiyid Ainuddin received a letter from the
Public Prosecutor C. I. D. informing him that the identifying
witnesses were all waiting at the house of another magistrate.
Leaving Ashfaqullah at the Central Jail Saiyid Ainuddin went to
40 the house of this magistrate and saw the witnesses. He then went
home, returned in the afternoon and had all the witnesses taken
to the jail in two motor lorries. Ex. P. A. 50 is the magistrate's
record of the identification proceedings. On arriving at the Jail
in the morning he had asked the jailor to have some Pathan con-
victs resembling Ashfaqullah waiting for him. Ashfaqullah asked
that some outsiders, that is non-residents of the jail, might be
paraded with him but the magistrate was unable to arrange
( 106 )
O. P. 166. this. The reason was that in the main case Mr. Mitra of the
Associated Press had arranged for the presence of some outsiders
and the accused in that case had made serious allegations against
Mr. Mitra and other sympathisers. Consequently nobody would
come forward to help Ashfaqullah (or Bakshi) in the same way.
The note recorded by the magistrate (Ex. P. A. 50) shows that five
other men were paraded with Ashfaqullah. All, including Ashfaq-
ullah, wore convict's dress. The frontier convicts, whom the magis-
trate considered himself fortunate to obtain for the purpose,
resembled Ashfaqullah in features "and had hair on the head and 10
moustaches and beard like him. Even their colour was similar to
his and also to a more or less extent their height". Before the
proceedings started Ashfaqullah again complained about his photo-
graph. The following passage from the note is also important in
view of the allegations made by Ashfaqullah:—"Ashfaqullah having
black nail on his left foot thumb I allowed him to conceal it by
placing a red cap over his feet and this was done by all the
men mixed up with him. At his own request I allowed him to take
off his own clothes and put on convict's dress............All the
five men mixed with him had exactly similar dress. They had small 20
beard like him and were Mohammadan Pathans having small beard
and moustache. After the proceedings were over Ashfaqullah
showed me a dim wart on his left temple. He never brought this
fact to my notice as he had done with the black nail. As it is no
witness ever had a look at his or any one else's temple or at
their feet. They looked straight into their faces and identified him
without any hesitation in a natural manner".
As regards the complaint that the magistrate did not arrange
for Ashfaqullah to be legally represented at the proceedings
O. P. 167 the magistrate's evidence shows that he told Ashfaqullah's brother 30
Riyasatullah on the Delhi railway station that he was taking him
to Lucknow and that he should also come to look after his inter-
ests. He informed the vakils for some of the accused in the main
case when identification proceedings would take place, because
they had made a written request to that effect. There was no
such request in Ashfaqullah's case. Ashfaqullah had been under
arrest for three weeks before the proceedings and his relatives
could have made arrangements for him to be legally represented
if they had wished to. They were able to engage a vakil for him
in the magistrate's court, although their means were insufficient to 40
retain him in this court, for which reason Ashfaqullah has been
defended in this court at Government expense. But the magistrate
was under no obligation of any kind to arrange for his legal repre-
sentation at the identification proceedings; it is by no means the us-
ual course for an accused to be represented at such proceedings, and
I see no reason whatever to think that the case of the accused has
been in any way prejudiced by the absence of a legal representa-
tive. Nor do I see any reason to think that the police have taken
( 107 )
an unfair advantage in any way, either by showing the witnesses
one of his photographs or by describing him to them. The pre-
cautions taken by the police to prevent the possibility of the
witnesses seeing him beforehand (and also the possibility of this
allegation being made) were of a most elaborate nature and there
is nothing which suggests bad faith on the part of anyone con-
cerned.
10 115. The other arguments advanced on behalf of Ashfaqullah
can be disposed of more briefly. It has been
(ii) Other arguments. contended in the first place that the whole
trial is vitiated by the fact that the committing magistrate took O. P. 168.
part in the inquiry, in particular by his conducting the identification
proceedings and by accompanying Banarsi Lal to Bichpuri. No
authority whatever has been quoted in support of this contention
and it is in my opinion without any force. On the other side it is
pointed out that under the explanation to section 556 of the Code of
Criminal Procedure no magistrate is personally interested in a case
20 within the meaning of the section by reason only that he has
viewed the place in which an offence is alleged to have been com-
mitted and made an inquiry in connection with the case. As the
proceedings before the magistrate are in the nature of an enquiry
and are not part of the actual trial it is, I think, clear that there
can be no valid objection to the magistrate taking part in the
inquiry before the case comes into his court by conducting iden-
tification proceedings and verifying a confession. Secondly it is
pointed out that none of the documents found with Ashfaqullah
directly connect him with the conspiracy; neither the white nor
30 the yellow leaflet was found with him; and a not very success-
ful attempt has been made to put an innocent construction on
the letters and papers found in his possession or written by
him I need not explain in detail how his counsel has attempted
to explain those passages which prima facie are of an incrimi-
nating nature; it is sufficient to say that I have found his
interpretations far from convincing.
Other points brought to my notice by the defence counsel
are, comparatively speaking, unimportant and can have little
effect on one's general views about the case. It is, for instance,
40 pointed out that Banarsi Lal has not been quite consistent in
his story about the visit of Jogesh Chander Chatterji to Shah-
jahanpur, as to how and where he first met him. It is also
pointed out that he has not been consistent in his story about the O. P. 169.
badmashes who took part in the Bichpuri dacoity. In his confes-
sion he said that they joined the party at Shahbaznagar while in his
statement to the court he suggested that they joined the party at
Sherganj. If the passages are closely examined, however; I think
it will be seen that they are not necessarily discrepant. He saw the
( 108 )
badmashes first of all at Sherganj but they may have got in the
train at Shahbaznagar and he may have learnt afterwards that
they did so. He was not cross-examined on the point. Then it is
argued that Banarsi Lal only mentioned the "chadar" which had
been left behind in the brake-van by the Kakori dacoits with a
view to having this part of his confession corroborated by the evi-
dence of the guard. The answer to this is that nobody would be
likely to trouble about corroboration on such a small point when
ample corroboration was forthcoming for the more important
details of his confession. Finally it is suggested that it was absurd 10
that Ram Prasad should ask Indu Bhushan to collect information
about officials and wealthy people when he must have known much
more about them himself. This implies that Ram Prasad asked
for the information because he really required it; it seems to me
much more likely that he asked Indu Bhushan to obtain the infor-
mation because Indu Bhushan was importuning him for work and
he wished to humour him, and also possibly because he thought it
would be good training for him.

202
To every man upon this earth,
Death cometh soon or late,
But (then) how can a man die better,
Than facing fearful odds,
For the ashes of his fathers and,
Temples of his God.
